These Terms of Service ("Terms") govern your use of Trusted Prenup ("Trusted Prenup", "we", "us"). By creating an account, making a purchase, or otherwise using the platform, you agree to these Terms. Please read them carefully.
Trusted Prenup provides an online platform and self-help tools for creating prenuptial agreement documents. Trusted Prenup is not a law firm and does not provide legal advice or legal representation. Using the platform does not create an attorney–client relationship with us, and your communications with us are not protected by attorney–client privilege.
We do not review your answers for legal sufficiency and we cannot and do not guarantee that any agreement you create will be valid or enforceable in any jurisdiction. Whether a prenuptial agreement is enforceable is ultimately decided by a court and depends on facts specific to you, your state's laws, and how the agreement was executed. For advice about your situation, consult a licensed attorney in your state.

A prenuptial agreement involves two people. Each partner uses their own account, and each is responsible for the accuracy and completeness of their own information and financial disclosures — an agreement is only as strong as the disclosures behind it. You agree that:
Attorneys available through the platform are independent professionals, not employees or agents of Trusted Prenup. If you purchase attorney review or a consultation, any attorney–client relationship formed is solely between you and that attorney. We do not direct, control, or influence an attorney's professional judgment, and we are not responsible for the advice they provide. Attorney services are subject to the attorney's own terms and to conflict-of-interest and licensing rules; an attorney may decline or end a representation.
If your purchase includes notarization, it is performed by a third-party online notary provider and is subject to that provider's requirements, including identity verification and the notarization laws of the applicable state. Availability of online notarization depends on your state and circumstances.

You may not scrape, crawl, harvest, or use automated means to extract data from the platform, and you may not use our content, templates, or documents to train, fine-tune, or develop any machine-learning or artificial-intelligence model, in each case without our prior written permission. Violations may result in termination of your access.
Prices are shown at checkout and charged as a one-time payment through our payment processor. We offer a 7-day money-back guarantee: if you're not satisfied, contact us within 7 days of your purchase and we'll make it right. Refund requests are reviewed on a case-by-case basis — email hello@trustedprenup.com and we'll take care of you.
The prenuptial agreement you create is yours. We do not claim ownership of the personal information or documents you generate. We may retain copies of your documents and data as needed to operate the service and as required by law, and we may preserve or disclose them where we reasonably believe doing so is required by law or necessary to protect safety or our rights. You are responsible for keeping your own copies of any final, signed originals.

The platform, its software, templates, and content are owned by Trusted Prenup and licensed to you for your personal, non-commercial use in creating your own agreement. You may download and keep your own documents for your personal records. You may not copy, resell, redistribute, modify, reverse-engineer, or create derivative works from the platform or its content except as these Terms allow.
If you believe content on the platform infringes your copyright, email hello@trustedprenup.com with enough detail to identify the work and the material at issue, and we will respond in accordance with applicable copyright law.
The platform may link to or integrate third-party sites and services (such as our payment processor, notary provider, and independent attorneys). We are not responsible for third-party content, availability, or practices, and your dealings with them are at your own risk and subject to their terms.
The service is provided "as is" and "as available," without warranties of any kind. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted or error-free, and we do not guarantee any particular legal outcome, including the enforceability of your agreement in any jurisdiction.
To the maximum extent permitted by law, our total liability for any claim relating to the service is limited to the amount you paid us for the service giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.
We may suspend or terminate access to the platform, with or without notice, if we reasonably believe you have violated these Terms or to protect the platform, our users, or ourselves from legal or security risk.
We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, pandemics, war, civil disturbance, labor disputes, or failures of third-party services or infrastructure.
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms or the service will be resolved exclusively in the state or federal courts located in New York County, New York, and you and we each consent to the jurisdiction of those courts.
Our failure to enforce any provision is not a waiver of it. If any provision is found unenforceable, the rest remain in effect and the unenforceable provision will be applied as closely as possible to its intent. You may not assign these Terms without our consent; we may assign them to an affiliate or successor.
We may update these Terms; material changes will be reflected in the "last updated" date above and, where they materially reduce your rights, we will take reasonable steps to notify you. Continued use after changes means you accept the updated Terms.
